Unable to Serve Court Documents? You May Still Have Legal Options

Serving court documents is often one of the first and most important steps in a legal matter. Whether you are commencing a debt recovery claim, civil litigation, family law proceedings, or a sole application for divorce, the other party usually needs to be properly notified before the matter can move forward.

However, service is not always straightforward.

The other party may have moved address, be avoiding contact, refuse to accept documents, live interstate or overseas, or simply be difficult to locate. When this occurs, your matter may be delayed and you may feel unsure about what steps can be taken next.

The good news is that difficulty with service does not always mean your case has to stop.

In appropriate circumstances, you may be able to apply to the court for orders allowing the documents to be served in another way. This is commonly known as substituted service.

Common situations where service becomes difficult

Service issues can arise in many types of legal matters, including:

civil litigation, where a defendant cannot be located or refuses to accept court documents;

debt recovery proceedings, where a debtor has moved or avoids contact;

business or commercial disputes, where a party no longer operates from their registered or known address; and

What is substituted service?

Substituted service allows court documents to be served by an alternative method when service in the usual way is not practicable.

Depending on the facts of the case, this may involve service by email, post, text message, delivery to a known address, service through another person connected to the other party, or a combination of different steps.

The court will usually consider whether the proposed method is likely to bring the documents to the other party’s attention.

A substituted service application must be carefully prepared. The court will usually require evidence showing what attempts have already been made to serve the documents, why the usual method of service has not been successful, and why the proposed alternative method is appropriate.

If the application is not supported by proper evidence, it may be refused. This can cause further delay, additional costs, and unnecessary frustration.
